Oppose: SJR4* 

Changes State Law to Appoint Instead of Elect Board of Regents

 


SJR4* passed the Legislature the first time in 2007 and is up for passage by the 

Legislature the second time. If it passes this time, it will go on the ballot, 

and if it is passed by the people it will become part of the Nevada Constitution. 

SJR4* takes away the right of the people to vote for the Board of Regents and makes them appointed by the Governor instead.  Some may say they should be appointed because there are problems with the Board of Regents, but the Constitution provides that the “power of the purse”, in other words, the power of the appropriation for their budget belongs to the Legislature. 

In addition, the Nevada Constitution in Art. 11 Section 7 provides that “a Board of Regents 
[is to] to control and manage the affairs of the University and the funds of the same under such regulations as may be provided by law.” One important argument in favor of AJR4* was that the Legislature had no control over the nearly 20% of the budget that the Board of Regents control. That is true only because the Legislature has not asserted it’s constitutional power to pass regulations in law that would direct the Board of Regents according to the will of the Legislature. 

Where is the accountability to the people if government officials are appointed and not elected? Elections are far better than back room deals by the good old boys or appointments as pay off. 

MESSAGE: Vote NO SJR4*. 

The people want to retain their right to vote on the Board of Regents. 

 

Senator Raggio is the sponsor. Hardy is a co-sponsor. Cegavaske voted Yes in 2007 

but has expressed some concerns and could be persuaded to vote No. 

 

Woodhouse, Mathews, Wiener, Lee all voted NO in 2007.
